WORTHLESS CHECK UNIT
I N T R O D U C T I O N
Until 1988, the procedure for prosecuting worthless check writers has been somewhat cumbersome and time consuming. Initially, the victim/merchant would first sign a complaint affidavit before a warrant Magistrate to obtain a warrant. Once issued, the Clerk's Office would forward the warrant to the Lee County Sheriff's Department for service on the worthless check writer. The defendant would then be arrested, booked into jail, bonded out, and a trial date would be set. The bond and warrant would then be returned to the Court Clerk and District Attorney's Office for docketing and a final resolution of the case in Court.
District Attorneys throughout the State sought to streamline the system and the legislature enacted enabling legislation. We have established a Worthless Check Unit in the Lee County District Attorney's Office to provide a central agency to assist victims/merchants in obtaining warrants and processing cases. This unit became operational in February, 1988.
The success of the program is dependent upon the continuing cooperation and support of the citizens and merchants in this County. In order to maintain that support, we have prepared this manual in order that you might better understand the law, your role, and the operation of the Worthless Check Unit
